Chandigarh April 1, 2022.Sh. Satya Pal Jain, Ex MP and Additional Solicitor General of India has said that resolution passed by the Punjab Vidhan Sabha today is “colourless”, “odourless” and “tasteless”. It seems to be an attempt to make April fool of the people on 1stApril, 2022.
Mr. Jain said that the applicability of Central Pay Scales to the employees of the UT Administration Chandigarh has been done under Article 309 of the Constitution which authorize the Central Government to frame rules. The Punjab Vidhan Sabha or the Punjab Government has no power to reject or pass resolution against those rules which have been framed by the Union Government by exercising powers given to it by the Constitution of India.
Mr. Jain said that It would have been better if the Punjab Government had come out with a resolution that it will give atleast the same salary and allowances, if not more to its own employees in Punjab and Chandigarh but the resolution is silent on that.
Mr. Jain said that in 1966 the reorganization of Punjab was done under the Punjab Reorganization Act, on the basis of recommendations of the Shah Commission. The Shah Commission had recommended the inclusion of entire Kharar Tehsil, of which Chandigarh was a part,to isHaryana but the then Central Government gave Kharar town to Punjab and Chandigarh, with 23 villages, was made a Union Territory. More than 55 years have passed since then, in spite of resolutions demands etc. etc., Chandigarh remains a UT.
The resolution passed today by the Punjab Vidhan Sabha today is only a repetition of the resolution passed earlier. It seems to be an attempt to divert the attention of the State from burning issues. The attitude of the Punjab Government is anti employee and anti people.
I will request the Chandigarh Union of Aam Admi Party to clarify as to whether they are in favour of transferring Chandigarh to Punjab or not.
